What is MSC Malaysia status?

MSC Malaysia status is a recognition granted by the Malaysian Government for ICT and ICT-facilities businesses that develop or use multimedia technologies to produce and promote their products and services.

What benefits does a MSC status company entitle to?

Depending on where their office is located, a MSC status company is entitled to enjoy up to 10 benefits, rights and privileges granted by the Malaysian Governement under 10 Bills of Guarantee (BOG) as follows:

2. Unrestricted local and foreign knowledge workers employment
3. No restriction on company ownership
4. Freedom to do global capital and funds sourcing for MSC Malaysia infrastructure
5. Tax exemption and other financial incentives

7. Freedom from internet censorship
8. Competitive telecommunications tariffs
9. Key MSC Malaysia infrastructure contracts for companies which are willing to use MSC Malaysia as their regional hub

What is MSC Malaysia Cybercity and Cybercentre?
MSC Malaysia Cybercities and Cybercentres are areas approved by the Malaysian MSC authorities as such. These areas are created with the aim of providing a conducive business environment to promote the growth of the local ICT industry. The Cybercities and Cybercentres are required to meet a set of globally competitive standards. Plans and policies have been put in place to facilitate the construction and provision of infrastructure in these areas. Must MSC Status Companies relocate to the MSC Malaysia Cybercenter/ Cybercities?
It is not mandatory for MSC Status Companies to relocate to MSC Malaysia Cybercenter/ Cybercities and its failure to do so would not result in its MSC Status to be revoked. However, if the MSC Status Company intends to enjoy the full benefits, rights and privileges offered to MSC Status Companies, then it should relocate to MSC Malaysia Cybercenter/ Cybercities as only if it does that it is entitled to enjoy the full benefits of a MSC Status Company.
What are the types of office premises that can be found wihin MSC Malaysia Cybercity/ Centre?
There are “Designated Premises” and “Other Commercial Premises” within MSC Cybercity/ Centre.
What does “Designated Premises” mean and what is the implication to the benefits or incentives enjoyed by MSC Status Companies located here?
Designated Premises” are the premises designated by the Malaysian Authorities which undertake to provide BOG1 i.e. to provide a world-class physical and information insfrastructure. MSC Status Companies which relocate to “Designated Premises” are able to enjoy all the benefits and incentives provided by the MSC authorities. Example of “Designated Premises” are the UOA Corporate Tower in Bangsar South, Plaza Sentral in KL Sentral, G Tower in KLCC, The Intermark in KLCC, etc.
What does “Other Commercial Premises” mean and what is the implication to the benefits or incentives enjoyed by MSC Status Companies located here?

Other Commercial Premises” refers to the commercial buildings/ offices located in MSC Cybercity/ Centre which are not Designated Premises. MSC Status Companies located in “Other Commercial Premises” will not be able to enjoy the following BOGs granted by the Government:

– BOG1: “To provide a world-class physical and information infrastructure” and
– BoG8: “To provide globally competitive telecommunications tariffs”

Example of “Other Commercial Premises” within MSC Cybercity/ Centre are The Vertical Business Suite in Bangsar South, Centrepoint in Mid Valley City, Q Sentral in KL Sentral etc.

How many types of MSC Status Companies are there?

There are 4 types of MSC Status Companies. Multi-tiered incentives are accorded to these 4 different types of MSC Status Companies depending on their office location.

Tier 1 – These are MSC Status Companies which are located in the “Designated Premises” within the MSC Malaysia Cybercity/ Centre
Tier 2 – These are MSC Status Companies which are located in the “Other Commercial Premises” within the MSC Malaysia Cybercity/ Centre
Tier 3 & MSC4Startups – These MSC Status Companies are located outside of MSC Malaysia Cybercit/ Centre

What are the benefits or incentives that can be enjoyed by the respective type of MSC Status Companies?
BOGs
– Only Tier 1 MSC Status Companies are able enjoy all the 10 BOGs granted by the Government. Tier 2 Companies have to forego BOG1 and 8 while the Tier 3/ MSC4Startups have to forego BOG1, 2, 5 & 8.
Financial Incentive
– Unlike the Tier 1 and 2 Companies which are entitled to 100% tax exemption, Tier 3 and MSC4Startups are only entitled to 70% income tax exemption for a period 5 years.
Recruitment of Foreign Knowledge Worker
– Tier 1 and 2 Companies are able to recruit unlimited number of foreign knowledge worker, while the Tier 3 and MSC4Startups are restricted to a maximum of 20 foreign knowledge workers at any one time
Can a non-MSC Status Company relocate to MSC Malaysia Cybercity/ Centres?
Yes, it can. There is no restriction against non-MSC Status Companies having an office in MSC Malaysia Cybercity/ Centres.
